Homeowners Association

  • The Homeowners Association is made up of representatives elected by the community, responsible for upholding the safety and security of the neighborhood through the enforcement of its covenants. Monthly meetings are held, typically on the second Tuesday of each month, with the annual meeting taking place in March. Every homeowner will be sent a formal notice of the annual meeting, including details, in advance. While homeowners are encouraged to attend these meetings, we ask that you inform the HOA of your planned attendance. This allows us to include any topics you wish to discuss in the agenda and gives the HOA board sufficient time to prepare for any agenda items.

  • Homeowners Association (HOA) covenants are a set of legally binding rules and guidelines established to maintain the quality and uniformity of a neighborhood or community. These covenants cover a wide range of topics, including property maintenance standards, architectural guidelines, and the use of common areas, ensuring that the community remains aesthetically pleasing and that property values are protected. Additionally, HOA covenants often specify the obligations of homeowners regarding dues and the community's governance, including how the HOA operates and how decisions are made. By agreeing to these covenants, homeowners commit to adhering to the rules that contribute to the overall well-being and harmonious living within the community.

  • Yes, Newport Landing HOA does have fees. The annual notice is mailed to each homeowner at the beginning of every year. These fee’s help pay for upgrades and enhancements around the lake as well as upkeep and maintenance of the neighborhood.

Lake & Boating Safety

All homeowners must accept the Lake Rules before gaining lake access. While below is not a comprehensive list of all lake rules, the following FAQs focus specifically on boating and lake safety.

  1. What are the steps to getting my boat on the lake?
    First, one should review and familiarize themselves and family with the Lake Rules that abide by Nebraska State Boating Laws. Secondly, you need to register your boat with the HOA, ensuring that your boat’s state registration is valid. Finally, you need to agree to HOA (state) Lake Rules. Once you receive your ramp code from the Lake Manager, you are free to launch your boat.

  2. Do I need a permit to operate a boat on the lake?
    Yes, all boats must be registered with the HOA and display current state registration to operate on the lake.

  3. Are there any restrictions on the type of boats allowed?
    Yes, the HOA restricts certain types of boats based on size, type, and motor horsepower to ensure safety and minimize environmental impact. Please refer to the HOA covenants for specific details.

  4. Is there a speed limit for boats on the lake?
    Yes, there is a lake-wide speed limit to ensure the safety of all users. The specific speed limit can be found in the HOA covenants or by contacting the Lake Manager.

  5. What is the lake pattern I keep hearing about?
    Bennington Lake enforces a counter-clockwise boating pattern at all times, every day of the year. This rule is established to enhance safety for everyone on the water, considering the lake's narrow channels and compact size.

  6. Are there designated areas for swimming or water sports?
    To ensure safety, the lake has designated no-wake zones (coves) for swimming and anchoring. It's important to familiarize yourself with these areas to prevent accidents. Water sports, including tubing, skiing, wake-surfing, and wakeboarding, are allowed in all areas of the lake that are not designated as no-wake zones.

  7. Are life jackets required?
    Yes, for safety reasons, the state law requires all boaters and passengers to have access to an appropriate life jacket. Boaters under the age of 13, MUST wear a life jacket in a boat at all times.

  8. Is fishing allowed from boats?
    Yes, fishing is allowed from boats, but anglers must follow state fishing regulations and HOA guidelines regarding fish size, limits, and permissible fishing areas.

  9. Are there specific boating or quiet hours on the lake?
    Boating is allowed at any time of the day where permitted safe. Loud music is not allowed from boats before 10am or after 11pm. The entire lake is NO WAKE 30 minutes AFTER sunset to 30 minutes BEFORE sunrise.

  10. Can guests bring their boats to the lake?
    No. All Permitted Watercraft on the Lake must be owned by an Owner or Family Member, must be registered with the Association, and must have an affixed current Association registration sticker in visible location on the starboard aft side. Please refer to HOA Lake Rules for further information.

  11. What should I do if I notice unsafe boating behavior?
    Report any unsafe behavior to the Lake Manager, providing as much detail as possible. If it is an emergency, dial 911.

  13. Are Jet-Skis allowed on the lake?
    Currently, jet-skis are permitted on the lake. However, it's important to review the specific Lake Rules related to jet-ski use. A notable state law to be aware of is the prohibition of operating jet-skis from SUNSET to SUNRISE. This regulation is particularly important due to the unique laws governing jet-ski operation. Once that sun goes down, the jet-ski MUST be off the water.

  14. How are lake water quality and cleanliness maintained?
    Please comply with Nebraska state law regarding the cleanliness of natural waters and lakes. Additionally, the HOA collaborates with the Nebraska Game and Parks Commission to conduct annual water quality testing.

  • The Design Review Committee (DRC) is a specialized group within the Homeowners Association (HOA) responsible for overseeing and maintaining the aesthetic and architectural standards of the community.

    This committee reviews and approves any proposed exterior modifications to properties, ensuring they align with the community's design guidelines and covenants.

    The existence of the DRC is crucial for preserving property values, ensuring uniformity, and maintaining the overall appeal of the neighborhood. By vetting changes, from landscaping to home additions, the DRC plays a key role in fostering a cohesive and attractive community environment.

  • Virtually all exterior changes to your property require approval, encompassing everything from new construction and additions to landscaping, decks, pools, and docks.
